Family Mediation

Family Mediation is for the use of couples who are in the process of separation or divorce.

It uses a neutral third party, the Mediator, to help those involved to come to mutually agreed arrangements for the future over Issues such as: money, property, residence and contact with children.

Participation is voluntary, confidential and “without prejudice”, and throughout the parties have control and are able to explore all Issues in an informal setting, at their own pace.

The process is less expensive and stressful than litigation or arbitration.

Mediators:

  • do not take sides or make decisions for you, nor do they give advice, but rather introduce options for you to explore
  • provide information, clarification and details where necessary and enable you to formulate proposals in a safe, neutral and relaxed environment
  • help you to identify areas where you and your partner are in agreement and to create mutually acceptable solutions to Issues which may prove to be difficult
  • ensure that all your family’s needs and wishes are taken into consideration

Documents

On completion of the process you will receive a copy of the :

MEMORANDUM of UNDERSTANDING - summary of your mutually acceptable proposals and an

OPEN FINANCIAL STATEMENT - contains an outline of your financial status together with supportive documentation

How long does it take?

On average three to five sessions in order to bring about a satisfactory outcome for all parties. However in some circumstances where arrangements are complicated, for example, there may need to be additional sessions.

How much does it cost?

The service is designed to reduce the overall costs incurred in divorce or separation. You will be advised of the hourly rate, based on a sliding scale assessment, at the first meeting.
